Terms of Service

End User License Agreement for the PostfixMe iOS application.

Notice: PostfixMe is licensed to you, not sold. By downloading or using the PostfixMe iOS application, you agree to these terms. The open source PostfixMe API is separately licensed under GPL-2.0-or-later and is governed by that license, not by these terms.

1. License grant

Subject to the terms of this Agreement, William W. Kimball, Jr., MBA, MSIS ("Developer") grants you a limited, non-exclusive, non-transferable, revocable license to download and use the PostfixMe iOS application ("App") on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes and as permitted by the App Store Terms and Conditions.

2. Restrictions

You may not:

  • Copy, modify, or distribute the App or any portion thereof
  • Reverse engineer, disassemble, or attempt to derive the source code of the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App in any manner that could damage, disable, overburden, or impair any server or network
  • Use the App to access any server or network without authorization from the operator of that server
  • Sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App

3. User-supplied infrastructure

The App requires connectivity to a PostfixMe API server that you or your organization deploy and maintain. The Developer:

  • Provides no server-side infrastructure for end users
  • Has no access to, control over, or responsibility for any server you configure the App to connect to
  • Makes no warranty about the availability, security, or reliability of any third-party server

You are entirely responsible for the PostfixMe API server you deploy, its security configuration, its data, and its availability.

4. Open source API

The PostfixMe API server component is separate from this App and is licensed under the GNU General Public License, version 2.0 or later (GPL-2.0-or-later). You may obtain the source code at https://github.com/wwkimball/postfixadmin-postfixme-api. These Terms of Service do not govern your use of the API source code; the GPL-2.0 license governs that use.

5. Intellectual property

The App, including its source code, user interface, graphics, and documentation, is the exclusive property of William W. Kimball, Jr., MBA, MSIS and is protected by copyright and other intellectual property laws. Nothing in these terms grants you any right, title, or interest in the App other than the limited license expressly granted herein.

6. Privacy

Your use of the App is also governed by the PostfixMe Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what data (if any) is collected.

7. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Your use of the App is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

9. User responsibilities

You are responsible for:

  • Maintaining the confidentiality of your mail server credentials
  • Any activity that occurs under your mail server account
  • Ensuring your use of the App complies with applicable laws and regulations
  • Complying with the terms and conditions of any third-party services (including PostfixAdmin) that the App interacts with through your configured server

10. Apple's role

These Terms are between you and the Developer, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support services for the App. To the extent required, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Termination

This license is effective until terminated. Your rights under this license will terminate automatically and without notice if you fail to comply with any term. Upon termination, you must stop using the App and delete all copies from your devices.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Major County, Oklahoma.

13. Changes to these terms

The Developer reserves the right to modify these Terms at any time. Material changes will be posted at https://postfixme.kimball.ninja/terms.html with an updated effective date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
